General Terms
Terms of Agreement
This Agreement goes into effect upon your acceptance of this Agreement as set forth in our Conditions of Use and shall continue, subject to the terms of this Agreement, until terminated by either party as permitted by these terms. Billing for your online, in-house, on-site, drop-off or telephone computer support service will apply on an 'as used' basis.
User Responsibility
You understand and agree that before Dynamic Solutions performs diagnostic service or repair of any kind on your computer, it is your responsibility to back up any important data, software, information, or any other files on your computers hard disk(s). It is also your responsibility to provide any CD's/DVD's of any programs installed, and all CD's/DVD's that came with your computer. These include but are not limited to: Operating System, drivers, tools, and any other specialty programs, which came with your computer. You acknowledge and agree that Dynamic Solutions shall not be responsible, under any circumstances whatsoever, for any loss or corruption of data and/or software.
Scheduling
Normal service hours are between 10 AM to 8 PM Weekdays, and from 10:30 AM to 5 PM Saturday. Emergency and expedited service may be available and requires additional charges. Services outside normal business hours are also available upon request for a minimal charge. Please call 248-686-1146 or fill out a Service Request form to schedule an appointment. All appointments made online through our scheduling system must be made at least 48 hours in advanced, and will be confirmed over the phone. Any appointment made within the 48 hour time frame will not be honored.
Pricing Agreement
All of the services that we offer is either charged at a "fixed" cost or at an "hourly" rate. The cost, whether "fixed" or "hourly," is given upfront before services are performed. Prices for many of our services are available through our website.
New customers are required to make payment on the date of service upon completion of work. There must be an authorized individual available to provide payment for our rendered services. If an authorized individual is not present, Dynamic Solutions technicians will remain until payment is made, and will be billed at our hourly rate.
Payment must be received within fourteen (14) days of service, unless otherwise stated. If not received by the 14th day, a 15% late fee will be charged for each week payment is past due. Letters for past due statements will be mailed on a weekly basis. After sixty (60) calendar days all bills will be sent to a collection agency, and customer will be responsible for any and all collection fees assessed.
Additional Services
At no time will our technicians render additional services that were not requested at the time the service call was scheduled. This includes: installing or upgrading software, installing or upgrading hardware, diagnosing and resolving any problems, and providing training of any kind that is not related to the scheduled service call. If you require additional services, our technician can help you schedule another appointment to complete those additional services.
Hardware & Software Purchases
Customers shall pay for all equipment cost, sales tax, and shipping upon delivery, as invoiced by Dynamic Solutions.
No equipment returns will be accepted by Dynamic Solutions unless accompanied by the original packaging and such return is within 14-days after delivery by Dynamic Solutions to the client. All equipment returns that were purchased from Dynamic Solutions are subject to a 15% restocking fee. Servers and special orders cannot be returned under any circumstance.
Dynamic Solutions does not provide warranty coverage on any original parts (including software) or equipment sold to customers. Dynamic Solutions warrants that its workmanship will be free of any defects upon completion of the work.
Orders over $500 require a 50% deposit before the order can be placed; after the order is placed, the deposit is non-refundable.
All cost estimates for orders of parts (including software) and equipment must be signed and approved by an authorized party before the order can be processed.
Estimates provided to customers expire 14-days after the date that the estimate is provided.
Software Licenses and Third Party Services
In connection with our Service, we may provide to you via download, CD, other media, or other delivery method, the use of certain software which is owned by Dynamic Solutions or its third party licensors, providers and suppliers, and which may be provided free or for a fee, including client and/or network security software ("Software"). We reserve the right to update or change the Software from time to time and you agree to cooperate in performing such steps as may be necessary to install any updates or upgrades to the Software. The Software used in conjunction with our Service may not be copied or used for any other purpose. Third Party Software: As part of the Services, Dynamic Solutions may suggest that you acquire, install and use certain third party software ("Third Party Software"). Third Party Software is licensed to you by the respective owners or licensees of the Third Party Software. You must agree to the terms and conditions set forth by such owners or licensees before installing Third Party Software whether Dynamic Solutions assists you in the acquisition, installation, and/or use of Third Party Software. Dynamic Solutions has no rights to the Third Party Software and does not license Third Party Software to you or make any representation or warranty regarding the Third Party Software. We make no warranty that we are an authorized service provider for Third Party Software or for any equipment; it is your sole responsibility to determine if you require additional rights in order for us to provide such support, and if so, to acquire such rights. You acknowledge that support of Third Party Software or equipment by an unauthorized service provider may void any warranty made by the supplier of such Third Party Software or equipment.
Service Guarantee
Our labor-oriented services (software diagnosing/repair, Operating system repair) carries a 21-day warranty from date of service. All hardware-related services are guaranteed under the manufacturers' specified warranty. Dynamic Solutions does not warranty that any hardware or software purchased will be free of defects or errors, and cannot refund any hardware that has already been used. All of our products come with atleast a 30 day manufacturers guarantee, in most cases 1 year, if any hardware problems arise with the specified warranty, you must contact the manufacturer for a replacement. However, if any changes to the system have been made either "directly" or "indirectly" will void the warranty.
Warranty Work
We provide warranty work for all of our labor oriented work that occurs within the 21-day period of the original date of service. Our warranty covers issues that arise from work, which was performed by our technicians. Our warranty Only covers the original work performed by our technicians. If warranty work is needed, the customer must contact us by phone or submit a service request You must allow us 24 to 48 hours to process your request. Dynamic Solutions, cannot be held liable for any work performed by any person(s) or company, which affects the use of your computer, any hardware, software or peripherals ability to function. This will immediately voids and terminates all agreements between Dynamic Solutions and "You." If we perform any warranty work, and find out that such service has been attempted to or performed by any person, and or company, you will be charged a minimum of 1 hour, and Dynamic Solutions reserves the right to refuse service at that time and any future work.
Cancellation and Refund
If you fail to notify us within 24 hours prior to scheduled service to either cancel or reschedule service, you will be charged a $75 cancellation fee. If services have been purchased online, and you notify us within the specified time frame above, we will refund the full price to you in the manner in which it was originally paid. If you are unsatisfied with our service for any reason, contact us and we will work to remedy your problem as quickly as possible.
Limitation of Liability
Under no circumstances shall Dynamic Solutions and/or its third-party service providers be liable to you or any other person for any damages, including, without limitation, any indirect, incidental, special or consequential damages, expenses, profits, lost saving or earnings, lost or corrupted data, or other liability arising out of, or related to the services provided by Dynamic Solutions, or the installation or the un-installation, use of, or inability to use your equipment, hardware, peripherals as a result of the services provided hereunder in this Agreement.
Typographical Errors & Labeling
Dynamic Solutions, in our best efforts keep our website material free from typographical errors and mistakes. In the event that such material is labeled incorrectly, or is associated with the incorrect price, we reserve the right not to honor that price. Some of the products and services listed on our website are general images, which do not reflect the actual product, which may appear different than the displayed image
Location and Access
For Dynamic Solutions to provide service of any kind, we must be able to have complete access to your system(s) and peripherals to be serviced; we must have your consent to access your residence or business; there must be a safe working environment for our technicians, and we must have easy access to electrical power and any software you have. For on-site services we require that an adult (at least 18 years of age) be present during the entire length of the service call. If an adult is not present when a Dynamic Solutions technician arrives, services will not be rendered, and you will be assessed a $100 charge.
Changes to Agreement
Dynamic Solutions will make a best effort to inform all of our current clients and registered members about changes made to this agreement, however we cannot guarantee that you will be notified of every change made. We also reserve the right to make changes to this agreement without prior notification. We will provide a date, each time this agreement is updated to make it possible to easily identify if there have been any changes since the last time you reviewed this document.
